Five cruelty to animals charges were DISMISSED against Robby Kuenzi, one of the three men accused of running over a herd of deer last winter with their snowmobiles.

Kuenzi's attorney, Thomas Johnson, convinced Judge John Hoffmann that since the men were hunting at the time of the incident, they could not be convicted of cruelty to animals. The DNR cited Kuenzi for hunting out of season, or poaching. This bolstered Johnson's defense against the five felony counts of cruelty to animals.

James Fassbender, the District Attorney prosecuting all three cases has made a request to J.B. Van Hollen, Wisconsin state's Attorney General to handle an appeal. The state has 20 days to appeal.

It is very important that this decision is appealed. We cannot let this precedent be set! Please contact Van Hollen's office in support of an appeal. Van Hollen is a self-proclaimed hunter. Any responsible hunter must see the danger in this dismissal. The three men acted violently, irrationally, and with no respect to wildlife. To allow them to be excused for this behavior is irresponsible.

Call Attorney General's office at 608-266-1221. Simply state that you favor the appeal of Judge Hoffmann's decision to dismiss the felony charges against Robby Kuenzi.

The abuse of any animal should never go unpunished. These snowmobilers not only chased the deer, who were unable to flee because of deep snow, but they tortured and brutally killed them. "This is a hideous and dispicable act," said Lynn Pauly, Executive Director of Alliance for Animals. "I can only imagine the fear and confusion of the deer, and the malice and mean sprits of those driving the vehicles."

Alliance for Animals urges you to attend any or all of the future court dates or contac court officials and demand that these individuals receive the maximum penalty, and that the severity of the behavior be weighed accordingly.
